1. Who we are

BPONitro (“BPONitro”, “we”, “us”) is a service operated by [Legal entity name], [company registration number], of [registered address], South Africa. These Terms govern your use of bponitro.com and related services (the “Service”). By creating an account you agree to these Terms.

2. What the Service is

BPONitro is a subscription software tool. It helps you discover work opportunities, prepare proposals, source providers who can deliver work under budget, and manage the resulting engagements. You pay a subscription fee to BPONitro and keep 100% of the profit you earn. BPONitro is not your employer, agent, or a party to the contracts you enter with your own clients or providers.

3. No income guarantee

We make no promise or guarantee of any income, earnings, or results. Any spreads, margins, or figures shown in the Service are estimates derived from third-party listings and are confirmed only when a provider actually quotes. Your results depend on your own effort, skill, market conditions, and the choices you make. Nothing in the Service or our marketing is a representation of expected earnings.

4. Third-party platforms and your own accounts

Where the Service acts on a third-party platform (for example a freelance marketplace), it does so only through your own authorised account and credentials, at your direction, and within that platform’s terms and rate limits. You are responsible for complying with the terms of any platform you connect, for the accuracy of what is submitted on your behalf, and for honouring any engagement you accept. You may disconnect a platform at any time. We never operate shared or “house” accounts on your behalf.

5. Acceptable use

You agree not to use the Service to break the law, to breach a third party’s terms, to submit false or misleading information, to spam, or to place unreasonable load on any connected platform. We may suspend or terminate accounts that do so.

6. Subscriptions, billing and cancellation

Subscription fees, billing intervals, and the currencies available are shown at checkout and are processed by our payment provider. Fees are billed in advance and recur until cancelled. You may cancel at any time; cancellation stops future renewals. Refunds are governed by our Refund Policy.

7. Intellectual property

The Service, including its scoring, matching, and pricing logic, is our confidential and proprietary property. You retain ownership of the content you upload and the work products of your own engagements.

8. Disclaimers and liability

The Service is provided “as is” without warranties of any kind. To the maximum extent permitted by law, we are not liable for indirect or consequential losses, lost profits, or lost opportunities, and our total liability is limited to the fees you paid us in the [six] months before the claim. Nothing limits liability that cannot be limited by law, including under the Consumer Protection Act, 2008.

9. Privacy

Your use of the Service is subject to our Privacy Policy and our POPIA / PAIA notice.

10. Changes and governing law
